Regulations for the provision of electronic services via the intodna.com website

I. Scope of the Regulations

 

  1. The Regulations regulate the provision of electronic services via the intodna.com website.
  2. It was introduced under the basis and within the limits of generally applicable law, in particular the Provision of Electronic Services Act, the Civil Code, the Protection of Certain Consumer Rights and Liability for Damage Caused by a Dangerous Product Act, the Copyright and Related Rights Act and the Telecommunications Law.
  3. The name of the Website, its concept, visual identification, software and database, as well as its individual word and graphic elements, which have been made available to Users by intodna.com, are subject to legal protection.

 

II. Definitions

 

The following definitions are used in the Regulations:

  1. “User” – a person using the Website who can view the content of the Website;
  2. “intoDNA” – the entity that is the owner of the Website, intoDNA S.A. with headquarters in Krakow, ul. Bobrzyńskiego 14, 30-348 Kraków, entered into the register of entrepreneurs kept by the District Court for Kraków-Śródmieście in Kraków, 11th Commercial Division of the National Court Register under the number KRS 0000874311 with tax identification number NIP 9452213325, REGON 368491518 share capital: PLN 100,000 fully paid up, e -mail: [email protected],
  3. “Regulations” – these regulations;
  4. “Website” – a website available at intodna.com
  5. “Services” – services provided for Users through intodna.com.

 

III. Use of the Website by Users

 

  1. The Website may be used by Users.
  2. Users have access to the passive functionalities of the Website and can browse the Website, in particular in order to use the Services.
  3. The User commences using the Website upon the commencement of receiving the data provided by intoDNA through the Website.
  4. Immediately after the home page is displayed on the User’s screen, he or she should read the content of the Regulations, which can be accessed using the appropriate link.
  5. The User ends the use of the Website upon the end of receiving the data provided by intoDNA via the Website.
  6. The User may terminate the use of the Website at all times, depending on his or her decision.

 

IV. Technical requirements

 

  1. To use the Website, it is necessary to have a device with Internet access (recommended connection of at least 512 kbps) and a web browser.
  2. In order to use some of the Website’s functionalities, it may be necessary to have additional software (eg Flash, text editor, programs supporting the PDF format, etc.).
  3. Any costs resulting from the use of distance communication by the User (costs of Internet connection, SMS, telephone calls) in order to use the Website, shall be borne by the User in accordance with the price lists of the suppliers whose services are used.
  4. intoDNA will make every effort to ensure that the Website works correctly and in full functionality at all times, however, it reserves the right to temporarily disable the Website or its individual functions in order to improve them, add new functionalities or carry out repair or maintenance.

 

V. Website Services

 

  1. The Website enables Users to view the content and use the tools to contact intoDNA, in particular for the purpose of sending recruitment applications.
  2. The Website provides Users with the use of all its functionalities available on the date of its use.
  3. IntoDNA may modify the package of Services available on the Website.

 

VI. Personal data

 

  1. IntoDNA respects Users’ personal data and meets the requirements of their protection resulting from the generally applicable provisions of law.
  2. The principles of data processing by intoDNA are specified in the Privacy Policy available at www.intodna.com/privacypolicy.

 

VII. Complaints procedure

 

  1. In the event of unsatisfactory quality of the Website Services provided by intoDNA, or of non-performance or improper performance of its obligations, the User is entitled to submit a complaint in this regard.
  2. Complaints shall be made by sending an e-mail to the address [email protected] with the word “complaint” or equivalent in the subject of the message.
  3. A correctly submitted complaint should contain at least the following data:
    – designation of the User (name, surname, e-mail address, and in the case of Users who are not natural persons, the name (company), address of the registered office and details of the natural person authorized to conduct matters related to the submitted complaint and its e-mail address,
    – a brief description of the submitted comments and objections.
  4. Complaints are considered by intoDNA immediately, not later than within 14 days.

 

VIII. Changing the Regulations

 

  1. IntoDNA reserves the right to amend the Regulations, and in relation to consumers only if the change is required by applicable law, as well as to improve the quality or extend the scope of the Services provided.
  2. The commencement of use of the Website by the User means acceptance of the Regulations in the valid wording. The current version of the Regulations is available at www.intodna.com/termsofuse.
  3. A user who does not accept the Regulations should immediately stop using the Website.

 

IX. Disputes

 

  1. Any disputes between intoDNA and the Users who are consumers shall be settled by the competent court in accordance with the provisions of the Code of Civil Procedure.
  2. Any disputes between intoDNA and non-consumer Users shall be resolved by intoDNA’s competent court which has a territorial jurisdiction over the place of the seat of intoDNA.

 

X. Final Provisions

 

  1. The Regulations enter into force on January 17, 2022.
  2. The Regulations are governed by Polish law.
  3. In matters not covered by the Regulations, the provisions of the Act on the provision of electronic services, the GDPR Regulation, the Act on the Protection of Personal Data, the Civil Code and other mandatory provisions of general law shall apply.

 


 

I. Zakres Regulaminu

 

  1. Regulamin reguluje świadczenie usług drogą elektroniczną za pośrednictwem serwisu intodna.com.
  2. Został on wprowadzony na podstawie i w granicach powszechnie obowiązujących przepisów prawa, w szczególności ustawy o świadczeniu usług drogą elektroniczną, Kodeksu cywilnego, ustawy o ochronie niektórych praw konsumentów oraz o odpowiedzialności za szkodę wyrządzoną przez produkt niebezpieczny, ustawy o prawie autorskim i prawach pokrewnych oraz ustawy prawo telekomunikacyjne.
  3. Nazwa Serwisu, jego koncepcja, identyfikacja wizualna, oprogramowanie oraz baza danych, a także poszczególne elementy słowne i graficzne Serwisu, które zostały udostępnione Użytkownikom przez intodna.com podlegają ochronie prawnej.

 

II. Definicje

 

W Regulaminie używane są następujące definicje:

  1. „Użytkownik” – osoba korzystająca z Serwisu, która może przeglądać treści zamieszone w Serwisie;
  2. „intoDNA” – podmiot będący właścicielem Serwisu intoDNA S.A. z siedzibą w Krakowie ul. Bobrzyńskiego 14, 30-348 Kraków wpisany do rejestru przedsiębiorców prowadzonego przez Sąd rejonowy dla Krakowa-Śródmieścia w Krakowie XI Wydział Gospodarczy Krajowego Rejestru Sądowego pod numerem KRS 0000874311 posiadająca numer identyfikacji podatkowej NIP 9452213325, REGON 368491518 kapitał zakładowy: 100.000 zł w pełni opłacony, e-mail: [email protected],
  3. „Regulamin” – niniejszy regulamin;
  4. „Serwis” – serwis internetowy, zamieszczony pod adresem internetowym intodna.com
  5. „Usługi” – usługi świadczone przez intodna.com przy pomocy Serwisu na rzecz Użytkowników.

 

III. Korzystanie z Serwisu przez Użytkowników

 

  1. Serwis może być użytkowany przez Użytkowników.
  2. Użytkownicy mają dostęp do pasywnych funkcjonalności Serwisu i mogą przeglądać Serwis, w tym zwłaszcza korzystać z Usług.
  3. Użytkownik rozpoczyna korzystanie z Serwisu z chwilą rozpoczęcia odbierania danych dostarczanych przez intoDNA za pomocą strony internetowej.
  4. Niezwłocznie po wyświetleniu się strony głównej na wyświetlaczu Użytkownika, powinien on zapoznać się z treścią Regulaminu, do którego dostęp możliwy jest przy użyciu odpowiedniego odnośnika.
  5. Użytkownik kończy korzystanie z Serwisu wraz z zakończeniem odbierania danych dostarczanych przez intoDNA za pośrednictwem Serwisu.
  6. Użytkownik może zakończyć korzystanie z Serwisu w dowolnym, zależnym od jego decyzji, momencie.

 

IV. Wymagania techniczne

 

  1. Do użytkowania Serwisu niezbędne jest posiadanie urządzenia z dostępem do Internetu (zalecane łącze co najmniej 512 kbps), oraz przeglądarki internetowej.
  2. W celu korzystania z niektórych funkcjonalności Serwisu niezbędne może być posiadanie dodatkowego oprogramowania (np. Flash, edytor tekstu, programy obsługujące format PDF itp.).
  3. Koszty wynikające z posługiwania się przez Użytkownika środkami porozumiewania się na odległość (koszty połączenia z Internetem, SMS, połączeń telefonicznych) celem skorzystania z Serwisu, ponosi Użytkownik zgodnie z cennikami dostawców, z których usług korzysta.
  4. intoDNA dołoży wszelkich starań, aby Serwis działał poprawnie i w pełnej funkcjonalności w każdym czasie, jednakże zastrzega sobie prawo do czasowego wyłączenia Serwisu lub jego poszczególnych funkcji w celu ich ulepszenia, dodania nowych funkcjonalności lub przeprowadzenia naprawy bądź konserwacji.

 

V. Usługi Serwisu

 

  1. Serwis umożliwia Użytkownikom przeglądanie treści oraz korzystanie z narzędzi do kontaktu z intoDNA, w szczególności w celu przesyłania aplikacji rekrutacyjnych.
  2. Serwis zapewnia Użytkownikom korzystanie ze wszystkich swoich funkcjonalności dostępnych w dacie jego użytkowania.
  3. IntoDNA może modyfikować pakiet Usług dostępnych w Serwisie.

 

VI. Dane osobowe

 

  1. IntoDNA szanuje dane osobowe Użytkowników i spełnia wymogi ich ochrony wynikające z powszechnie obowiązujących przepisów prawa.
  2. Zasady przetwarzania danych przez intoDNA określa Polityka Prywatności dostępna pod adresem www.intodna.com/privacypolicy.

 

VII. Postępowanie reklamacyjne

 

  1. W razie niezadowalającej jakości Usług Serwisu świadczonych przez intoDNA, bądź też niewykonania lub nienależytego wykonania przez niego zobowiązań, Użytkownik uprawniony jest do zgłoszenia w tym zakresie reklamacji.
  2. Reklamacje zgłasza się, wysyłając e-mail na adres [email protected] wpisując w temacie wiadomości określenie „reklamacja” lub równoważne.
  3. Prawidłowo złożona reklamacja powinna zawierać co najmniej następujące dane:
    – oznaczenie Użytkownika (imię, nazwisko, adres e-mail, a w przypadku Użytkowników niebędących osobami fizycznymi nazwę (firmę), adres siedziby oraz dane osoby fizycznej upoważnionej do prowadzenia spraw związanych ze złożoną reklamacją oraz jej adres e-mail),
    – zwięzły opis zgłaszanych uwag i zastrzeżeń.
  4. Reklamacje rozpatrywane są przez intoDNA niezwłocznie, nie później niż w terminie 14 dni.

 

VIII. Zmiana Regulaminu

 

  1. IntoDNA zastrzega sobie prawo do dokonywania zmian Regulaminu, zaś w stosunku do konsumentów wyłącznie jeżeli zmiana jest wymagana przepisami obowiązującego prawa, a także w celu poprawy jakości lub rozszerzenia zakresu świadczonych Usług.
  2. Rozpoczęcie przez Użytkownika korzystania z Serwisu oznacza akceptację Regulaminu w obowiązującym brzmieniu. Aktualna wersja Regulaminu znajduje się na stronie www.intodna.com/termsofuse.
  3. Użytkownik, który nie akceptuje Regulamin winien bezzwłocznie zaprzestać korzystania z Serwisu.

 

IX. Spory

 

  1. Wszelkie spory pomiędzy intoDNA a Użytkownikami będącymi konsumentami rozstrzyga właściwy miejscowo sąd zgodnie z przepisami Kodeksu postępowania cywilnego.
  2. Wszelkie spory pomiędzy intoDNA a Użytkownikami niebędącymi konsumentami rozstrzyga Sąd właściwy miejscowo dla intoDNA.

 

X. Postanowienia końcowe

 

  1. Regulamin wchodzi w życie z dniem 17 stycznia 2022 r.
  2. Regulamin podlega prawu polskiemu.
  3. W sprawach nieuregulowanych w Regulaminie zastosowanie mają przepisy ustawy o świadczeniu usług drogą elektroniczną, Rozporządzenia RODO, ustawy o ochronie danych osobowych, Kodeksu cywilnego i inne bezwzględnie obowiązujące przepisy prawa powszechnego.
